Children playing on bike, 2 injured, 1 dead: Part 2

Unfortunately, there is nothing happy to report about this update. Last week, this blog detailed a post regarding a motorized bicycle accident that injured 2 children and killed 1 when pick-up truck rode over the bike as the children were playing in the street.

The driver of the truck reports that he was only driving 15 miles per hour but that there still was not enough time to avoid running over the bike. The post detailed that initially only one of the children, a 2-year-old little boy, was killed in this bicycle accident. Tragically, the 9-year-old girl passed away this week as well.

Falling tree limb robs teen of promising future

"There is no future for him anymore," says a devastated father regarding the condition of his son -- wheelchair-bound, vision and hearing impaired, and brain damaged. The family has filed suit on the grounds of premises liability in the wake of a tree branch that feel from a rotted oak and struck the teen. Intelligent and athletic, the boy's hopes for a bright future were dimmed in an instant.

According to The New York Times, in New York in the last five years, there have been 51 injuries, including 2 deaths, from falling tree limbs. These accidents are not indigenous to New York; a falling tree limb can be a serious liability in Ohio as well.

In a tragic Ohio accident that recently resulted in devastating injury, 3 families are likely devastated. It appears that three children were riding on a mini-motor bike when they were in the street and stuck by a passing pick-up truck. The children ages 11, 9 and 2 were all injured. Tragically, the 2-year-old little boy was killed.

Reportedly, the children were in a place on the street that they should not have been in, but you can hardly blame children for not knowing such things, particularly the 2-year-old. The truck driver was reportedly cooperative at the scene and at this point has not been charge in this bike accident, but the family of the 2-year-old could potentially choose to pursue a wrongful death claim.

Bicyclist injured in hit-and-run accident

We hear too many times after a bicycle accident that the driver didn't see the bicycle on the road. Drivers frequently drive at excessive speed when bicyclists are present, and too often drivers think it is convenient to flee the scene after a bicycle accident occurred.

What happened in a neighboring state could have occurred in Youngtown as well. A bicyclist riding with her boyfriend heard a loud noise and was then thrown through the air. She had been struck by a speeding car that quickly left the scene of the accident while the victim remained lying in the middle of the road.

As detailed in previous posts, the link between concussions and permanent brain injury is becoming more readily apparent. Presently, there are over 50 lawsuits encompassing over 1,200 former NFL players over the resulting brain damage sustained due to the high-contact sport.

Ohio-based company deemed negligent in mining blast that killed 29

"If anything happens to me, I will be looking down from heaven."

These are the ominous words handwritten by one miner in a letter to his then 19-month-old daughter, mere months before the miner was taken in a fatal accident. According the miner's fiancé, the man was rightfully worried that something would happen to him due to hazardous work conditions in the mine. The Upper Big Branch mining blast that claimed the father's life killed 29 men in total as the chain-reaction blast blazed through seven miles of underground corridors.

Partial settlement reached in Ohio wrongful death

A reportedly self-sustaining 49-year-old Ohio man that was quiet and kept to himself was shot and killed when officers raided his Ohio home in Feb. 2007. Reportedly, authorities had obtained a search warranted that stated that the premises that the Ohio man lived on possessed stolen goods, including baby clothes and baby furniture, from an area Walmart. However, the man was not even the target of the raid. The warrant even stated that victim was only a resident of the property.

Reportedly, authorities did not announce themselves before their raid so the Ohio man began shooting, apparently unaware of what was happening and why authorities were entering his home. Consequently, when police began firing in return, the Ohio man caught two bullets to the chest which proved fatal according to the coroner. His family filed a wrongful death claim against authorities.

20 year old dies when bulimia not properly treated

One young man, just 20 years old, carried pain beyond his years. He was of a larger build and struggled with self-esteem issues. He began wrestling and purging to meet weight. A bright but struggling student, the young man dropped out of college when his self-esteem and issues with bulimia got out of control and he developed further problems with alcohol. The young man sought treatment with the support of his family and hoped to return to his studies. He will never get that chance.

According to a lawsuit, the young man's family is suing the two rehabilitation centers that were taking care of him when he died due to complications from bulimia. The suit is suing for an unlimited amount of damages due to a failure to administer proper care, resulting in the young man's wrongful death.

Cyclist fatally strikes pedestrian, possible charges to follow

In Ohio and elsewhere, residents catch wind of countless cases of negligent drivers hitting bicyclists that they didn't see, resulting in a potential wrongful death. However, rarely do we hear of such events turned on their head.

One biker was barreling down the street when the light changed from green to yellow. He had a fleeting second to decide, either break hard or hunker down. Not dancing between indecision, the bicyclist flattened his body against his bike as the streets began flooding with pedestrians.
